1.1 The following General Terms and Conditions apply to all use of and orders placed on the website atelierlavague.com (hereinafter, the Website).
1.2 The owner of the website is ATELIER LA VAGUE DI TIPHAINE VINCENT (hereinafter, Atelier La Vague), a company registered in Italy under company number VNCTHN90S58Z110F and with registered offices at via San Bernardino 93D – 24126 BERGAMO.
All purchases of products carried out through the Website by Clients are governed by these General Terms and Conditions. Prior to carrying out any purchase, the Client is therefore required to carefully read these General Terms and Conditions. At the execution of the Purchase Agreement the Client agrees and undertakes to comply with them.
2. Purchasing procedure
2.1 The Client may purchase any Product available in the e-catalogue. All the products are illustrated in detail on the Website. The visual display of Products on the Website, where available, has an approximate value only, and it is usually in the form of a photo image of the Products themselves, with the sole purpose to present them for sale, without any guarantee or commitment by Atelier La Vague regarding the exact match of the image depicted on the Website with the actual Product; this specifically refers to the actual dimensions and/or colours of the Products and/or their packaging. Each Product is handmade and unique.
2.2 After submitting your order, Atelier La Vague will send an order confirmation with the date and order number to the email address indicated by the Client in the purchase procedure. If the order is not accepted by Atelier La Vague, Atelier La Vague will contact the Client immediately and refund the paid amount.
3. Prices and currency
3.1 The price of the Products is the one shown on the Website when the order is placed by the Client. The prices are in Euro and exclude VAT because all the purchases made through the Website are nontaxable as per Italian law art. 1, commi da 54 a 89 della Legge n. 190/2014 – Regime forfettario.
3.2 Atelier La Vague only adds the shipping charges to the total amount. It may vary depending on the place of destination.
4. Product availability
The availability of each Product is shown on the Website. If one Product is not available, the Client may send a request by email at firstname.lastname@example.org.
5. Payment methods
The purchased Products may be paid by the Client through the Paypal system, with the Client’s own Paypal account or with credit card. The Client will be automatically redirected to the Paypal website and will be able to conclude the order and proceed with payment.
6. Shipping methods and charges
6.1 The Products are shipped from Italy to the European Union. The charges are calculated depending on the place of destination. The Client may found further details on the dedicated page Delivery and returns.
6.2 Once the order is confirmed, the Products are shipped within 3 weekdays (except in case of annual holidays indicated on the Website’s homepage).
All the shipments are made by Poste Italiane. The delivery time in Italy is 4 to 6 weekdays. The delivery time for European Union is around 6-10 working days.
7.1 The Client is entitled to withdraw the purchase by sending notice thereof to Atelier La Vague within 10 weekdays of the date on which the Client has received the Product. Once the notice has been sent by email at email@example.com, the Client will receive a reply with all the details in order to proceed with the return of the Products. The shipping charges to return the Products are to be paid by the Client.
7.2 The right of withdrawal is correctly exercised if it is in accordance with the following conditions:
The Products must not be used, worn, cleaned or damaged;
The Products must be returned to the forwarder within 10 weekdays of the date on which the Client has received the Product;
Once the Product is returned, Atelier La Vague may check if the Product is in accordance with the conditions mentioned above.
If the right of withdrawal is correctly exercised, Atelier La Vague will refund the paid amount to the Client. The refund will be made as soon as reasonably practicable, or in any case, within 30 days of the date on which the Products have been returned.
7.3 The right of withdrawal will not be valid in the following conditions:
The withdrawal period has expired (10 weekdays of the date on which the Client has received the Product)
The Product is damaged.
In this case, the paid amount will not be refunded to the Client.
Nevertheless, the Client may ask for the return of the Product by sending an email at firstname.lastname@example.org and Atelier La Vague will resend the Product. The shipping charges are to be paid by the Client.
The purchased Product may be returned within 10 weekdays of the date on which the Client has received the Product. The Client may have to proceed with the return (paragraph 7) and then purchase another Product on the Website.
9. Customer service
The Client may ask for help and information by email at email@example.com.
The General Terms and Conditions, as well as the entire Website, are available in English, Italian and French. If there is any conflict, ambiguity, or discrepancy between the Italian version and a version in another language, the Italian version shall always prevail.
11. Processing of Personal Data
11.1 ATELIER LA VAGUE DI TIPHAINE VINCENT collects personal data when the Client submits an order on the Website. Personal information will be processed for purposes related to the fulfillment of the requested services and obligations related to the execution of the contract. Atelier La Vague does not sell or rent personal data to any other entity. Atelier La Vague respects Italian law on personal data processing and particularly D.lgs. n. 196/2003 (Codice Privacy).
11.2 The Client is entitled at any time to request removal of any personal data from Atelier La Vague’s customer database by sending an email at firstname.lastname@example.org.
12. Applicable law and Place of jurisdiction
12.1 These General Terms and Conditions as well as any other contract entered into with the Client are governed by Italian law.
12.2 Any controversy arising from or relating to the interpretation, execution, validity or efficacy of these General Terms and Conditions and of any other contract entered into with the Clients will be submitted to the exclusive jurisdiction of the Bergamo courts (Italy).
